Terms & Conditions

Empire Win (hereinafter referred to as "the Platform," "we," "us," or "our") is an online real money gaming tournament platform that enables registered users to participate in competitive gaming tournaments for games including Free Fire, BGMI (Battlegrounds Mobile India), COD Mobile, and other supported titles. The Platform is operated under the brand name Empire Win and is accessible via our website and associated mobile applications.

These Terms & Conditions ("Terms," "Agreement") constitute a legally binding contract between you ("User," "you," or "your") and Empire Win governing your access to and use of all services, features, content, and functionality offered through the Platform, including but not limited to tournament participation, wallet operations, payment processing, leaderboards, chat, and reward systems.

Empire Win is a skill-based gaming platform. Tournaments are competitions of skill where outcome is determined by a player's gaming ability, strategy, and performance — not by chance alone. However, participation involves real money and inherent financial risk. Users participate at their own volition and financial risk.

To use Empire Win and participate in any tournament, you must satisfy all of the following eligibility requirements:

• check_circle Age Requirement: You must be at least 18 (eighteen) years of age to register an account and participate in any real money tournament or financial activity on the Platform. Users between 13–17 years of age may only access non-monetary, informational sections of the Platform with verifiable parental/guardian consent. Any user found to be under 13 years of age will have their account immediately and permanently terminated.
• check_circle Geographic Eligibility: The Platform is primarily intended for users residing in India. You are solely responsible for determining whether accessing or participating in real money gaming is legal in your state, territory, or jurisdiction. Empire Win explicitly excludes users from states where online real money gaming is prohibited by law, including but not limited to Assam, Odisha, Telangana, Andhra Pradesh, Nagaland (unless licensed), Sikkim (unless licensed), and Meghalaya. If you are a resident of these regions, you are not permitted to participate in paid tournaments.
• check_circle Accurate Information: You must provide true, accurate, current, and complete information during registration and at all times during your use of the Platform. This includes but is not limited to your legal name, date of birth, email address, phone number, and in-game UID. Providing false information is grounds for immediate account termination and forfeiture of all balances.
• check_circle Legal Capacity: You must have full legal capacity to enter into a binding contract under the laws of India. Persons declared legally incompetent, those under active judicial restraints, or minors not satisfying the age requirement herein are not eligible to use the Platform for financial activities.
• check_circle Not Previously Banned: You must not have been previously suspended or permanently banned from Empire Win or any affiliated platform due to policy violations, fraudulent activity, or breach of these Terms.

Each individual is permitted to hold exactly one (1) account on Empire Win. The creation of multiple accounts by a single individual — regardless of the device, IP address, email address, phone number, or method used — is a serious violation of these Terms and will result in the immediate and permanent termination of all associated accounts and forfeiture of all balances therein, without any refund.

Account Security & Responsibility: You are solely and entirely responsible for:

• arrow_rightMaintaining the strict confidentiality of your account credentials, including your Google account login linked to Empire Win.
• arrow_rightAll activities, transactions, tournament entries, chat messages, and financial operations that occur under your account — whether or not authorized by you.
• arrow_rightImmediately notifying Empire Win support if you suspect unauthorized access to your account or any security breach.
• arrow_rightEnsuring that your device and Google account are secured from unauthorized access, including the use of screen locks, two-factor authentication, and other security measures.
• arrow_rightKeeping your registered email address, phone number, UPI ID, and in-game UID current and accurate at all times.

Account Verification: Empire Win reserves the right to request identity verification (KYC — Know Your Customer) documents at any time, including but not limited to government-issued photo ID, proof of address, date of birth verification, or bank account details. Refusal to provide requested verification documents may result in account suspension and restriction of withdrawal privileges until compliance is achieved.

Account Transferability: Your Empire Win account is strictly personal and non-transferable. You may not sell, gift, lease, or otherwise transfer your account or any rights therein to any third party. Accounts found to have been transferred will be permanently terminated.

Empire Win hosts skill-based competitive gaming tournaments across multiple game titles. Participation in any tournament constitutes acceptance of these Rules in addition to the general Terms.

4.1 Entry Fees

Tournaments on Empire Win may carry an entry fee, which is deducted from the User's wallet balance at the time of joining. The entry fee for each tournament is clearly displayed on the tournament listing page before a user joins. By clicking "Join Tournament," you expressly authorize the deduction of the applicable entry fee from your wallet. Entry fees are non-refundable once a tournament has commenced, except as specified in the Refund Policy (Section 13).

4.2 Match Participation

• check_circleUsers must join the tournament room within the allotted time using the Room ID and Password provided by Empire Win administrators.
• check_circleUsers are required to use the same in-game UID registered on their Empire Win profile. Playing under a different UID is a disqualifying violation.
• check_circleUsers must take a clear screenshot of the final match results screen (showing rank, kills, and username) and submit it within the designated timeframe where required.
• check_circleFailure to join a match after entry registration, due to any reason attributable to the user, will result in forfeiture of the entry fee. No refund will be issued.
• check_circleResults submitted will be verified by Empire Win administrators. Falsified screenshots or data manipulation will result in disqualification, account suspension, and potential legal action.

4.3 Fair Play Requirement

Empire Win maintains a strict fair play policy. All tournament participants are required to compete honestly, using only legitimate in-game skills and officially permitted gameplay mechanics.

• cancelNo Cheating: Using any cheat software, auto-aim programs, speed hacks, ESP (Extra Sensory Perception) tools, or any unauthorized third-party software that modifies or interferes with normal gameplay is strictly prohibited.
• cancelNo Hacking: Attempting to hack, reverse-engineer, or exploit vulnerabilities in the Empire Win platform, its servers, databases, APIs, or associated game servers is strictly prohibited and constitutes a criminal offense under the Information Technology Act, 2000 (India).
• cancelNo Bug Exploitation: Deliberately exploiting known or unknown bugs, glitches, or errors in the game or on the Platform for competitive advantage is prohibited.
• cancelNo Teaming: Colluding with other participants to deliberately manipulate match outcomes (e.g., match-fixing, team play in solo modes) is prohibited.
• cancelNo Result Manipulation: Submitting false, edited, or fabricated screenshots or game results is prohibited and constitutes fraud.

5.1 Winning Calculation

Prize money for each tournament is calculated based on the prize breakdown structure published on the tournament listing page prior to the tournament's commencement. Prize distributions may be based on final rank, kill count, or a combination thereof, as specified per tournament. Empire Win reserves the right to determine the final prize structure for each tournament, which shall be announced before the tournament begins and shall not be modified after the tournament starts, except in cases of technical failure or force majeure.

5.2 Credit of Winnings

Verified winnings are credited to the User's Winning Balance (within the wallet) upon successful result verification by Empire Win administrators. The processing time for crediting winnings may be up to 24 hours after the tournament concludes. Empire Win will make reasonable efforts to credit winnings promptly but does not guarantee a specific time frame in all cases.

5.3 Platform Decision is Final

5.4 Fraudulent Wins

If Empire Win determines, at any time and through any means, that a user obtained tournament winnings through fraudulent activity, cheating, result manipulation, exploitation of platform errors, collusion, or any other dishonest means, Empire Win reserves the right to:

• cancelCancel and reverse the fraudulent winnings from the user's wallet without prior notice.
• cancelSuspend or permanently terminate the user's account.
• cancelForfeit all wallet balances (deposited and winning) without refund.
• cancelPursue civil and/or criminal legal action against the user for fraud, cheating, and financial misappropriation under applicable Indian law.

5.5 Tax Obligations

Users are solely responsible for reporting and paying all applicable taxes on their winnings in compliance with Indian tax laws, including TDS (Tax Deducted at Source) provisions where applicable. Empire Win may be legally required to deduct TDS on winnings exceeding statutory thresholds as per the Income Tax Act, 1961. Empire Win shall not be liable for any tax liability incurred by users.

Every registered Empire Win account is associated with an internal digital wallet (the "Wallet") that facilitates financial transactions on the Platform. The Wallet is not a bank account and does not carry any banking protections.

6.1 Platform Control

The Wallet system is entirely owned, operated, and controlled by Empire Win. All wallet operations — including credits, debits, holds, freezes, and corrections — are conducted at the Platform's sole discretion in accordance with these Terms. The Wallet is an internal accounting system maintained for the purposes of facilitating tournament participation and reward distribution on the Platform.

6.2 Error Correction

6.3 Wallet Freezing

Empire Win may freeze, hold, or restrict access to Wallet funds in cases of suspected fraud, ongoing disputes, chargebacks, regulatory requirements, security investigations, or any other situation that Empire Win deems to require such action. Frozen funds will be reviewed on a case-by-case basis and released or forfeited based on the outcome of the investigation.

6.4 No Interest

No interest, return, or yield of any kind shall accrue on any balance held in your Empire Win Wallet. The Wallet is a non-interest-bearing internal credit system.

6.5 Wallet Expiry

Empire Win reserves the right to expire or reduce wallet balances in accounts that have been inactive (no login, tournament, or transaction activity) for a period exceeding 12 (twelve) consecutive months. Users will be notified via registered email at least 30 days prior to such expiry.

Empire Win enables users to add funds to their Wallet through supported payment methods to facilitate tournament entry and other Platform activities.

7.1 Accepted Payment Methods

• arrow_rightUPI (Unified Payments Interface): Payments via UPI using the Platform's designated UPI ID (mohitfuzacore@fam / Empire Win). Users must scan the QR code or manually enter the UPI ID displayed on the payment page.
• arrow_rightOther Methods: Any additional payment methods displayed on the payment page at the time of deposit, which may be updated or changed by Empire Win from time to time at its sole discretion.

7.2 Deposit Limits

7.3 Deposit Bonus Structure

Deposit bonuses are credited at the Platform's discretion and may be modified or discontinued at any time without prior notice. Bonus amounts may be subject to usage restrictions and may not be directly withdrawable without meeting applicable conditions.

7.4 UTR / Transaction Reference

After making a UPI payment, users must submit the UTR (Unique Transaction Reference) number and optionally a payment screenshot through the Empire Win payment confirmation page. Failure to submit a valid UTR may result in delayed or rejected credit. Empire Win will verify all UPI payments with the payment records before crediting the Wallet.

7.5 Fraudulent Deposits

Any attempt to make a fraudulent payment, including chargebacks, disputed UPI transactions, or payment reversals after Wallet credit, constitutes fraud. Empire Win will immediately freeze the associated account, reverse the credited amount, and may pursue legal action for recovery of funds, damages, and legal costs.

Registered users who meet all eligibility criteria may request withdrawal of available wallet balance (deposited balance and/or winning balance) to their verified bank account or UPI ID, subject to the rules and limits defined herein.

8.1 Withdrawal Process

• arrow_rightUser submits a withdrawal request through the Wallet section of the Platform, specifying the amount and receiving UPI ID or bank details.
• arrow_rightEmpire Win administrators review and verify the request, including checking for pending disputes, suspicious activity, and account standing.
• arrow_rightUpon approval, the withdrawal amount is processed to the user's designated payment method within the stated processing timeframe.
• arrow_rightThe withdrawn amount is debited from the user's Wallet at the time of request submission.

8.2 Grounds for Withdrawal Delay or Rejection

Empire Win reserves the right to delay, hold, or reject any withdrawal request in the following circumstances:

• warningSuspected fraudulent activity, including but not limited to unusual win patterns, multiple accounts, or irregular deposit-withdrawal cycles.
• warningOngoing security investigation or fraud detection review pertaining to the user's account.
• warningViolation of any provision of these Terms, including fair play violations, prohibited activities, or eligibility breaches.
• warningPending identity verification (KYC) requirements not yet fulfilled by the user.
• warningOutstanding disputes or chargebacks related to the user's account.
• warningTechnical issues with the payment processing system.
• warningRegulatory or legal requirements mandating the hold.

Empire Win may, at its discretion, offer redeemable rewards as part of promotional activities, special tournaments, or loyalty programs. These rewards may include Google Play redeem codes, in-game currency codes, gift vouchers, or other digital goods (collectively, "Reward Codes").

9.1 Reward Code Delivery

• arrow_rightEligible users may request or receive Reward Codes through the Platform's redeem section, support channel, or as announced by Empire Win.
• arrow_rightAll Reward Code requests are subject to manual admin review and approval before delivery.
• arrow_rightApproved Reward Codes will be delivered via the user's registered email address or through the in-app messaging system.
• arrow_rightDelivery timelines will vary and are not guaranteed to occur within any specific timeframe.

9.2 Reward Eligibility Conditions

Empire Win reserves the right to impose eligibility conditions on any reward program, including minimum wallet activity, tournament participation thresholds, or account verification requirements. Rewards are non-transferable and may only be used by the account holder for whom they were issued. Any attempt to sell, exchange, or transfer Reward Codes is prohibited.

9.3 Reward Program Modifications

Empire Win reserves the right to modify, suspend, discontinue, or cancel any reward program at any time without prior notice and without liability to users, except for codes that have already been approved and confirmed for delivery prior to such cancellation.

10.1 Record Keeping

Empire Win maintains a comprehensive, timestamped record of all financial transactions associated with each user account, including but not limited to deposits, tournament entry fee debits, prize credits, withdrawal debits, bonus credits, and balance adjustments. These records are maintained on secure servers and are accessible to users through the Transaction History section of their account.

10.2 User Access

Users may view their complete transaction history through their Profile or Wallet section on the Platform at any time while their account is active and in good standing. Transaction records include transaction type, amount, reference ID, timestamp, and status.

10.3 Platform Records as Final Authority

Transaction records will be retained by Empire Win for a minimum period of 5 (five) years from the date of each transaction, in compliance with applicable financial record-keeping regulations. Upon account deletion, transaction history may be archived and retained in compliance with legal requirements.

The following activities are strictly prohibited on Empire Win. Engaging in any of these activities will result in immediate account suspension or permanent termination, forfeiture of all wallet balances, and may lead to civil and/or criminal legal proceedings against you:

• cancelMultiple Accounts: Creating, operating, or benefiting from more than one Empire Win account per individual, regardless of the device, email, phone number, or payment method used.
• cancelIdentity Fraud: Registering using another person's identity, providing false personal information, or impersonating another user or entity.
• cancelCheating and Unfair Gameplay: Using cheat engines, hacks, aimbots, wallhacks, macros, or any other software or method that provides an unfair competitive advantage in tournaments.
• cancelBug and Exploit Abuse: Deliberately exploiting platform bugs, payment system vulnerabilities, wallet calculation errors, or any software glitches for personal financial gain.
• cancelFake Payments and Deposit Fraud: Submitting false UTR numbers, fake payment screenshots, initiating chargebacks on legitimate transactions, or any other form of payment fraud.
• cancelResult Manipulation: Submitting falsified, edited, or manipulated game result screenshots. Colluding with other players to fix match outcomes.
• cancelPlatform Hacking: Attempting to gain unauthorized access to Empire Win servers, databases, admin panels, Firebase instances, or any other backend infrastructure.
• cancelMalicious Code: Introducing viruses, malware, bots, scripts, or any other harmful code into the Platform's systems.
• cancelAccount Sharing or Selling: Allowing another person to access or operate your account, or selling, purchasing, or transferring accounts.
• cancelHarassment and Abusive Conduct: Using the Platform's chat or any communication channel to harass, abuse, threaten, defame, or discriminate against other users, staff, or administrators.
• cancelSpam and Promotion: Sending unsolicited promotional messages, referral links, external URLs, or any form of spam through the Platform's communication channels.
• cancelMoney Laundering: Using the Platform for any money laundering activities or to process funds derived from illegal sources.
• cancelCircumventing Restrictions: Using VPNs, proxy servers, emulators, or other technologies to circumvent geographic restrictions, account bans, or Platform security measures.

12.1 Platform's Right to Act

Empire Win reserves the right — exercisable at its sole discretion and without prior notice — to temporarily suspend, permanently ban, or terminate any user account at any time. This right may be exercised for any reason deemed sufficient by Empire Win, including but not limited to:

• warningFraud, cheating, result manipulation, or any other dishonest conduct as described in Section 4 and Section 11.
• warningViolation of any provision of these Terms & Conditions.
• warningDetection of suspicious financial activity, including unusual deposit-withdrawal patterns, multiple accounts, or chargeback attempts.
• warningFailure to comply with identity verification (KYC) requirements within the specified timeframe.
• warningAbusive, threatening, or offensive behavior toward other users, Platform staff, or administrators.
• warningSubmission of false or misleading information to the Platform or its staff.
• warningLegal, regulatory, or law enforcement requirements mandating account action.
• warningExtended account inactivity (as defined in Section 6.5).

12.2 Appeal Process

Users who believe their account was suspended or terminated in error may submit a formal appeal to Empire Win support at support@empirewin.in within 14 days of receiving notification of the suspension or termination. Empire Win will review appeals on a case-by-case basis. The outcome of the appeal process is at Empire Win's sole discretion and is final.

12.3 User-Initiated Deletion

Users may request account deletion by contacting Empire Win support. Upon account deletion, any remaining wallet balance may be withdrawn (subject to applicable minimums, verification, and absence of pending violations) before deletion is processed. Once an account is deleted, the action is irreversible and all associated data will be processed in accordance with the Privacy Policy.

13.1 Tournament Entry Fees

Tournament entry fees are strictly non-refundable once a tournament has commenced, regardless of the reason for non-participation by the user, including but not limited to: change of mind, technical issues on the user's device, failure to join the room, power outage, internet connectivity issues, or any other reason attributable to the user. Entry fees may be refunded in the following limited circumstances only:

• check_circleEmpire Win cancels a tournament before it commences, due to insufficient participants or Platform-side technical failure. In such cases, the entry fee will be credited back to the user's Deposited Balance.
• check_circleA demonstrable, confirmed technical error on Empire Win's server-side systems prevented a user from joining a tournament they had successfully registered for, verified by Empire Win's technical team.

13.2 Wallet Deposits

Deposits made to the Empire Win Wallet are non-refundable to the user's original payment method, with the following sole exception:

• check_circleA confirmed, documented technical error on the part of Empire Win's payment processing system resulted in a double deduction, over-charge, or failed-but-charged transaction, where funds were debited from the user's bank account but not credited to the Empire Win Wallet. Such claims must be supported by bank statement evidence and reported within 7 days of the transaction.

13.3 Platform Decision is Final

All refund decisions are made exclusively by Empire Win and are final and binding. Empire Win's determination of whether a refund is warranted in any given case shall not be subject to challenge through any means other than the formal appeal/support process. Empire Win's decision on refund eligibility is based on its internal records and technical logs, which are the definitive source of truth.

To the fullest extent permitted under applicable Indian law, Empire Win, its owners, operators, directors, employees, agents, and affiliates (collectively, "Empire Win Parties") hereby exclude all liability for:

• cancelGameplay Losses: Any financial loss, including tournament entry fees, resulting from a user's tournament performance, skill level, match outcomes, or any other gameplay-related result. Participation in real money tournaments inherently involves financial risk, and Empire Win is not liable for any such losses.
• cancelTechnical Issues: Any loss or damage arising from technical malfunctions, software bugs, errors, data corruption, server failures, platform unavailability, or interruptions to the Platform's service for any reason, including scheduled or unscheduled maintenance.
• cancelServer Downtime: Any inability to access the Platform, participate in tournaments, or conduct wallet operations due to server downtime, DDoS attacks, infrastructure failures, or force majeure events including but not limited to acts of God, natural disasters, pandemics, government actions, internet service disruptions, or telecommunications failures.
• cancelThird-Party Payment Failures: Any loss arising from failures, delays, or errors of third-party payment processors, UPI service providers, banking systems, or any other financial intermediaries used in connection with the Platform.
• cancelData Loss: Any loss of user data, transaction records, or account information due to technical failures, cyberattacks, or any other cause beyond Empire Win's reasonable control.
• cancelUnauthorized Account Access: Any financial loss or damage resulting from unauthorized access to a user's account due to the user's own negligence in account security.
• cancelIndirect Damages: Any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the Platform, regardless of whether Empire Win was advised of the possibility of such damages.

Nothing in this section shall exclude liability for death or personal injury caused by Empire Win's gross negligence, fraud, or fraudulent misrepresentation, to the extent such exclusion is not permitted by law.

Empire Win integrates with and relies upon third-party service providers to deliver various components of its Platform functionality. These include but are not limited to:

By using the Platform, you acknowledge that:

• arrow_rightEach third-party service is governed by its own terms of service, privacy policy, and data handling practices, over which Empire Win has no control.
• arrow_rightEmpire Win is not liable for any service interruptions, data breaches, privacy violations, errors, or losses caused by any third-party service provider.
• arrow_rightYour use of third-party services in connection with Empire Win constitutes your acceptance of those services' respective terms and policies.
• arrow_rightEmpire Win does not endorse and makes no warranty regarding the reliability, security, or accuracy of any third-party service.
• arrow_rightThird-party services may be changed, discontinued, or modified at any time without notice to Empire Win or users, and Empire Win will not be held responsible for any impact such changes have on Platform functionality.

Any links to third-party websites or applications accessible through the Platform are provided for convenience only. Empire Win does not control and is not responsible for the content, privacy practices, or terms of any third-party website.

The collection, storage, processing, use, and disclosure of your personal information by Empire Win is governed by our separate Privacy Policy, which is incorporated into and forms an integral part of these Terms & Conditions by reference.

By agreeing to these Terms, you also agree to the Privacy Policy. The Privacy Policy describes in detail:

• arrow_rightHow your data is stored, secured, and protected against unauthorized access.
• arrow_rightHow your data may be shared with trusted third-party service providers for operational purposes.
• arrow_rightYour rights with respect to your personal data under applicable law, including the right to access, correct, and request deletion of your data.
• arrow_rightEmpire Win's compliance with the Information Technology Act, 2000, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

17.1 Right to Modify

Empire Win reserves the right to modify, amend, update, replace, or supplement these Terms & Conditions at any time and for any reason, at its sole discretion. Such modifications may include changes to existing sections, addition of new sections, or removal of existing provisions. Modifications may be made in response to changes in applicable law, regulatory requirements, business operations, service offerings, payment processes, or user feedback.

17.2 Notification of Changes

Empire Win will endeavor to notify users of material changes to these Terms through one or more of the following methods:

• arrow_rightSending an email notification to the user's registered email address.
• arrow_rightUpdating the "Last Updated" date displayed at the top of this document.

17.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with the nearest enforceable equivalent that reflects the original intent.

17.4 Entire Agreement

These Terms, together with the Privacy Policy and any tournament-specific rules published on the Platform, constitute the entire agreement between you and Empire Win regarding your use of the Platform and supersede all prior agreements, understandings, representations, and arrangements.

18.1 Governing Law

These Terms & Conditions, and any dispute, claim, or controversy arising out of or relating to them or to your use of the Empire Win Platform — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory — shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.

18.2 Jurisdiction

You irrevocably submit to the exclusive jurisdiction of the competent civil courts located in India for the resolution of any disputes arising out of or in connection with these Terms or the Platform. If any jurisdictional question arises as to the specific court of jurisdiction, the matter shall be decided by the most appropriate court of competent jurisdiction within India as determined by applicable law.

18.3 Applicable Legislation

Your use of Empire Win is subject to all applicable Indian laws and regulations, including but not limited to:

• arrow_rightThe Indian Contract Act, 1872.
• arrow_rightThe Consumer Protection Act, 2019.
• arrow_rightThe Prevention of Money Laundering Act, 2002 (PMLA).
• arrow_rightThe Income Tax Act, 1961, including TDS provisions applicable to online gaming winnings.
• arrow_rightThe Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
• arrow_rightApplicable state laws governing online gaming and skill-based competitions in the user's state of residence.

18.4 Dispute Resolution

In the event of a dispute between you and Empire Win, you agree to first attempt resolution through Empire Win's official support channel (support@empirewin.in). If the dispute is not resolved through support within 30 days of escalation, either party may seek resolution through competent legal proceedings in Indian courts as specified above. Class action lawsuits or collective legal proceedings against Empire Win are not permitted under these Terms.
